These Terms of Service (“Terms”) govern your use of the GutReset mobile application (“App”) operated by GutReset (“we,” “our,” or “us”). By using the App, you agree to these Terms.
1. Description of Service
GutReset is a wellness application that provides a structured 30-day elimination and reintroduction protocol to help you identify potential food sensitivities. The App includes meal and symptom tracking, daily check-ins, educational content, and AI-generated insights based on your logged data.
2. Important Health Disclaimer
GutReset is a wellness tool, NOT a medical device.
- The App does NOT diagnose, treat, cure, or prevent any disease or medical condition.
- The information provided in the App is for educational and informational purposes only.
- AI-generated insights report correlations and patterns in your data. They are NOT medical advice or clinical diagnoses.
- The elimination diet protocol is a general wellness approach. It is NOT a substitute for professional medical advice, diagnosis, or treatment.
- Always consult your healthcare provider before making significant changes to your diet, especially if you have existing medical conditions, are pregnant or nursing, or are taking medications.
- If you experience severe or persistent symptoms, seek medical attention immediately.
3. Eligibility
You must be at least 13 years old to use the App. If you are under 18, you should use the App with parental or guardian guidance.
4. Subscriptions & Payments
Pricing
GutReset offers subscription plans (weekly, monthly, annual). Prices are displayed in the App and may vary by region.
Free Trial
Some plans include a free trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.
Billing
- Subscriptions are billed through Apple’s App Store.
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
Cancellation
- You can cancel your subscription at any time through your Apple ID account settings.
- Cancellation takes effect at the end of the current billing period.
- No refunds are provided for partial subscription periods.
Refunds
Refund requests are handled by Apple according to their refund policies.
5. Your Data
Ownership
You own all data you create in the App, including meal logs, symptom logs, check-ins, and notes.
Data Portability
You can export your data at any time from Settings > Export My Data.
Data Deletion
You can delete all your data at any time from Settings > Delete All Data. This action is irreversible.
Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
6. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse engineer, decompile, or disassemble the App
- Share your subscription with others or use unauthorized methods to access premium features
- Submit false, misleading, or harmful content through the App
7. Intellectual Property
All content in the App, including text, graphics, educational materials, recipes, and AI-generated insights, is owned by or licensed to GutReset and is protected by intellectual property laws. You may not copy, distribute, or create derivative works from App content without our written permission.
8. AI-Generated Content
The App uses artificial intelligence to generate personalized insights based on your logged data. AI-generated content:
- Is based on pattern analysis of your individual data
- May not always be accurate or applicable to your specific health situation
- Should be considered informational, not prescriptive
- Does not replace professional medical or nutritional advice
9. Limitation of Liability
To the maximum extent permitted by law:
- GutReset is provided “as is” without warranties of any kind
- We are not liable for any health outcomes resulting from your use of the App
- We are not liable for any indirect, incidental, special, or consequential damages
- Our total liability is limited to the amount you paid for the App in the 12 months preceding the claim
10. Indemnification
You agree to indemnify and hold harmless GutReset from any claims, losses, or damages arising from your use of the App or violation of these Terms.
11. Changes to Terms
We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. Material changes will be communicated through the App.
12. Termination
We may suspend or terminate your access to the App if you violate these Terms. Upon termination, your right to use the App ceases, but your data remains on your device until you delete it.
13. Governing Law
These Terms are governed by the laws of the Netherlands, without regard to conflict of law provisions.
